UMNO FILES ORIGINATING SUMMONS SEEKING TRANSFER OF LAND FROM TUN M AND THREE OTHERS

KUALA LUMPUR, April 10 (Bernama) -- UMNO has filed an originating summons seeking a court declaration to transfer ownership of a 9,723-square-metre parcel of land in the capital to the party.

The action was initiated by Umno’s executive secretary, Datuk Mohd Sumali Reduan, through Messrs Hafarizam Wan & Aisha Mubarak at the High Court here on March 6, naming the Registrar of the Federal Territory Land and Mines Office as the defendant.

UMNO’s counsel Nor Hazira Abu Haiyan confirmed that during case management before High Court deputy registrar Nur Shasha Hidayah Nor Azahar today, the court fixed May 2 for the next case management.

The party is seeking an order for the transfer of ownership of Grant 78154, Lot 40, Section 51, Kuala Lumpur, currently registered under the names of the trustees, the late Tun Daim Zainuddin, Tun Musa Hitam, Tun Dr Mahathir Mohamad and the late Tan Sri Sanusi Junid to UMNO pursuant to Clause 27.1 of the United Malays National Organisation Constitution and Section 9 of the Societies Act 1966.

UMNO is also seeking an order compelling the Registrar of Titles or the Federal Territory Land Administrator to execute the order by endorsing a memorial on the title document.

According to the supporting affidavit, Mohd Sumali stated that based on the Schedule 17 Form, an application for consent to transfer ownership of the said land dated Oct 27, 2015, which an attached Statutory Declaration dated Oct 22, 2015, was confirmed and signed by the four trustees concerned.

"Two of the trustees, Sanusi and Daim, have since passed away. Sanusi on March 9, 2018, and Daim on Nov 13, 2024. Daim’s passing is a matter of public knowledge, as it was widely reported on platforms both offline and online," he said.

Sumali further stated that the UMNO office bearers, namely the President, Deputy President, and Secretary-General, had agreed via a Statutory Declaration dated Dec 10, 2015, to re-register the said property to the party.

He added that through a letter dated Dec 28, 2015, from the Federal Territory Land and Mines Director’s Office, the Federal Territory Kuala Lumpur Land Working Committee had approved the transfer of ownership from the trustees to UMNO.

"However, when Form 14A dated April 25, 2016, for executing the transfer was submitted by UMNO’s legal counsel to the Federal Territory Land and Mines Office in Kuala Lumpur, the application was rejected on May 18, 2017, on the grounds that the names stated on the land title did not match the names on the identity cards," he said.
